After much excitement and waiting for Eva by Expression Image (Exprssnimg) at Runtime DNA, a short sales period and the lucky purchase of her by a few artists, Eva was quickly pulled back off the market by Runtime DNA for some kind of problem they cannot share with the public.  Many speculate it is related to her legal sales or Daz3D trying to get her off the market due to some similarity to Victoria, their prized industry standard model which many have based their character packages and clothing packages off of.  Daz3D is probabaly already struggling with the problems of the recession but holding their head up high and marching forward with ever changing new selections of 3D content for Smith Micro's Poser and Daz3D Studio. Is it related to Daz3D or is Expression Image protecting his rights so Runtime DNA does not try to own his product.  We have even heard that she was on vacation in the Swiss Alps or somewhere skiing.

We can say for sure Daz 3D has always been favorable in the sales of many new and beautiful base models of many types and we sort of doubt they would try to stop EVA from coming out.  They would be best served marketing her products and getting her name out as well as all their other products because of their large base of customers who have platnum accounts.  It all just amounts to more money for Daz 3D if they support her.  I personally spend a large amount of money every year at Daz3D and I know if Eva's products were to be supported there that would only amount in me spending larger amounts of money there in the future.  I think the problem has not come from Daz 3D but that is only my speculation.

All of Expression Images products were pulled off the market and it is reported by Runtime DNA that contracts are being put into place to protect all parties, etc.  Runtime DNA reports that they are eager to bring Eva back to the 3D market where she will be available for 3D artists who want to buy her.  Everything is hush hush at the moment with many promises to tell the story of what is happening later.  What a frustrating time for the creator of Eva as all his products are being prevented from sales.  How horrific!

It is mentioned in the forum that the merchant has removed their entire line from Runtime DNA for what ever reason.  This particular news makes me very sad because I really hope to get more of his products in the future. I hope they figure this out and that the vendor returns when things are worked out.  Many Artists are feeling sick of the roller coaster of emotion they are getting when trying to obtain Eva or her products from Runtime DNA.  They are shocked and feeling a loss for Eva and they are hoping she will pop up again somewhere.

One good note is that Runtime DNA is acting responsibly at least telling folks they will try to resolve any legal issues, that they look forward to Eva's return and that they are very much working to get her back.

Many users have demanded refunds but many who like Eva and who want to be prepared for her continue to use her for development so that when she is released they can continue with their marketing and artwork.  I personally was lucky to grab her and some of Expression Images other wonderful products and I hope that others were lucky enough to grab her quickly too.  Customers at Runtime DNA report Sheer Frustration over losing Eva at the moment and are anxiously awaiting news of her.

Eva is a base model so there is much that she could grow into in the future including a runner up or strong competitor for Victoria 4 or her other versions.  As morph packages are released for her in the future and as her mesh is upgraded I guarantee she will be a definate strong competitor for Victoria 4 although she has a ways to go at the moment, she still holds great promise for artists who are currently frustrated and feeling shut out from Runtime DNA regarding her whereabouts.

There are rumors about copied mesh, however Eva looks somewhat different in her creation to me than V4.  Her hands and feet are definitely different.  Her face is somewhat unrefined at this point and is definately original.   Her eyelids and facial skin seem to have some mesh issues so I think it is pretty original and there are things that will need updates on her showing that she is not an exact replica of another model.   Her body is more tall, lithe and bony than V4 so I am feeling a completely not the same vibe from Eva and I hope you find that too.  Eva's breasts too have a different shape and look than V4.

Is the problem related to copyright of the human anatomy?  Can a mesh of the human anatomy be copyrighted because this would cause all future models of the human race to be unable to be sold.  That would be an outrage and a crime.  Like anything if it is slightly different in any way, then it is different.  Using another idea as a vision is not a crime however copying it directly and calling it yours is.  If you have a dinosaur model with legs and someone makes a new dinosaur like yours with legs can that really be considered copyright infringement?  I think not.  You should not be able to copyright anatomy but you could probably copyright specific names, texture maps, etc.  We wish we were attorneys here but we aren't so we will leave it to the professionals.

There should also be laws about making original products and then changing them only slightly and calling them original meshes when they are simply the same dress modified and re-textured.  No one seems to give a darn about those vendors who cut corners and then bring in lots of cash from the same model.  But that is capitalism at it's finest.

Here at Kimberly3D we support Eva, we will be putting out some freebies for her and we will be rooting for Expression Image.  We love you Eva and you are always going to be in our hearts and hopefully in our artwork.
